Information on data protection regarding our processing of applicant data in accordance with art. 13, 14 and 21 of the basic data protection regulation (GDPR)

Thank you for your interest in our company. In accordance with the provisions of Articles 13, 14 and 21 of the General Data Protection Regulation (GDPR), we are informing you in this information sheet about the processing of the personal data you submit as part of the application process and any personal data we collect and your rights in this regard. To ensure that you are fully informed about the processing of personal data as part of the application process, please take note of the following information.

Type of personal data collected
We process data in connection with your application. This may include general personal data (such as your name, address and contact details), details of your professional qualifications and school education or details of further professional training or other information that you provide to us in connection with your application.
Which sources and data do we use?
We process personal data that we receive from you by post or email as part of your application or that you send to us.
If we commission a recruitment consultant, we process personal data when we receive the complete application documents of a recommended applicant from the consultant.
We process your data for the following purposes and on the following legal basis
We process your personal data in accordance with the provisions of the European General Data Protection Regulation (GDPR) for the purpose of your application for an employment relationship, insofar as this is necessary for the decision on the establishment of an employment relationship with us. The legal basis for this is the decision to establish an employment relationship (Section 26 (1) BDSG).
Furthermore, we may process personal data about you insofar as this is necessary for the defence of legal claims asserted against us. The legal basis for this is Art. 6 para. 1 lit. f GDPR; the legitimate interest here is, for example, a burden of proof in proceedings under the General Equal Treatment Act (AGG).
If you have expressly consented to inclusion in our talent pool, we may take your personal data into account for future job advertisements in our company on the basis of your consent in accordance with Art. 6 para. 1 lit. a) GDPR. In addition, with your consent, we process your data to send you notifications about new job advertisements or other career opportunities that may be of interest to you.
You can withdraw your consent at any time. Please note that the revocation only takes effect for the future. Processing that took place before the revocation is not affected.
Who receives your data?
We only pass on your personal data within our company to those areas that require this data to fulfil contractual and legal obligations or to implement our legitimate interest.
Is data transferred to a third country or to an international organisation?
Data is transferred to bodies in countries outside the European Economic Area (so-called third countries) insofar as this is required by law (e.g. reporting obligations under tax law), you have given us your consent or this is legitimised by the legitimate interest under data protection law and no higher interests of the data subject worthy of protection stand in the way.
Furthermore, we do not transfer any personal data to bodies in third countries or international organisations.
How long will your data be stored?
We store your personal data for as long as this is necessary for the decision on your application. Your personal data or application documents will be deleted a maximum of six months after the end of the application process (e.g. the announcement of the rejection decision), unless longer storage is legally required or permitted. We only store your personal data beyond this if this is required by law or in a specific case for the assertion, exercise or defence of legal claims for the duration of a legal dispute.
If an employment relationship, training relationship or internship relationship is established following the application process, the data will initially be stored for at least the duration of the employment at Hüngsberg GmbH, if necessary and permissible, and then transferred to the personnel file.
If you have consented to the further storage of your personal data, we will transfer your data to our applicant pool. There they will be deleted one year after obtaining or renewing your consent, whichever occurs later.
Which data protection rights do you have?
Every data subject has the right of access pursuant to Art. 15 GDPR, right to rectification pursuant to Art. 16 GDPR, right to erasure pursuant to Art. 17 GDPR, right to restriction of processing pursuant to Art. 19 GDPR, right to object from Art. 21 GDPR as well as the right to data portability from Art. 20 GDPR.
With the right to access and the right to erasure, the restrictions in accordance with §§ 34 and 35 BDSG apply.
In addition, there is a right to lodge a complaint with a competent data protection supervisory authority (Art. 77 GDPR). The supervisory authority responsible for us is:

Am I obligated to provide data?
The provision of personal data is neither legally nor contractually required. However, it is not possible to process the application without this information.
Withdrawal of your consent
You can withdraw your consent to the storage of your personal data and its use for the application process at any time. The revocation can be requested by sending an e-mail to the person responsible for data protection.
Information on your right to object according to art. 21 (1) GDPR
Case-specific right to object
You have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you which is based on point (f) of Article 6(1) GDPR. If you object, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims.
